Privacy Notice
DEAR USER, at AB HEALTH & WELLNESS SA DE CV, we are aware of the importance of the proper protection of your personal data. Therefore, in accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (“LFPDPPP”), "atoms studios," with its address at Calzada San Pedro, 603, Local 301, Colonia del Valle, San Pedro Garza García, Nuevo León, in the City of Monterrey, C.P. 66220, provides you with the following Privacy Notice. The purpose is for you to have full knowledge about the processing of your personal data and to facilitate the exercise of your rights under the LFPDPPP.
1. Personal Data Processed. The general personal data we collect from our clients are: name, address, telephone number, gender, and email. Furthermore, if the client chooses to pay for services provided by "atoms studio" through recurring charges or direct debits, we will collect information about their bank account, credit card, or debit card. Additionally, to ensure that the physical conditioning activities you perform at "atoms studio" are appropriate for your health, "atoms studio" may collect the following sensitive personal data: physical performance test results, weight, height, body fat and muscle mass percentage, allergies, possible heart conditions, chronic degenerative diseases, contagious diseases, neurological diseases, musculoskeletal diseases, data from research on the etiology of obesity in Mexico and possible reversal factors, and, if applicable, physiological limitations that could affect physical conditioning activities.
It is important to note that all the general personal data mentioned above are essential for "atoms studio" to provide its clients with the contracted services. Therefore, revoking consent or exercising the right of cancellation for the processing of this data will result in the termination of the contract with "atoms studio" without liability for the latter.
2. Purposes of Data Processing. Your personal data is used (processed) for the following purposes: (i) contract subscription, (ii) identification and verification; (iii) contact; (iv) identification upon access to the facilities; and (v) understanding of your general health status.
For sensitive personal data, these will be used exclusively for the following purposes: (i) to make recommendations for appropriate physical conditioning for you; (ii) for the correct management of any emergency situation that requires the health information that "atoms studio" has.
Additionally, your personal data will be used for the following commercial and promotional purposes: (i) to send you information about our products or services, (ii) to conduct surveys on the quality of our services; (iii) to send you offers and promotions from "atoms studio" and its affiliated companies; and/or (iv) to promote raffles and events organized by "atoms studio". If you do not want your personal data to be used for the commercial and promotional purposes described above, you can contact us at any time to limit this processing via our email at hola@atomstudio.com.mx or directly at our offices located at Calzada San Pedro, 603, Local 301, Colonia del Valle, San Pedro Garza García, Nuevo León, in the City of Monterrey, C.P. 66220. To ensure the proper protection of your personal data and to fully comply with the obligations established by the LFPDPPP, you are informed that AB HEALTH & WELLNESS SA DE CV has implemented the necessary and sufficient administrative, technical, and physical security measures for the correct protection of the data.
3. Exercise of ARCO Rights. You can, at any time, exercise your rights of Access, Rectification, Cancellation, and Opposition to the processing of your personal data before "atoms studio". To do so, you must submit a written request directly to our offices located at Calzada San Pedro, 603, Local 301, Colonia del Valle, San Pedro Garza García, Nuevo León, in the City of Monterrey, C.P. 66220, and/or to the email address hola@atomstudio.com.mx. The request must contain at least: (a) your name and address or another means to communicate the response to your request; (b) the documents that prove your identity or, if applicable, legal representation; (c) a clear and precise description of the personal data for which you wish to exercise one of the ARCO rights; (d) the express statement of the right (access, rectification, cancellation, or opposition) you want to exercise regarding the processing of your personal data; and (e) any other element that facilitates the location of the personal data.
4. Data Transfers. AB HEALTH & WELLNESS SA DE CV may transfer your personal data to its subsidiary or affiliated companies of the same business group for the commercial and promotional purposes described in section 2 of this Privacy Notice. In the case of the sensitive data described in section 1 of this Privacy Notice, "atoms studio" will not make any type of transfer to its subsidiary or affiliated companies or to any other third party. Under no circumstances will "atoms studio" transfer the personal data of its clients to a third party, other than the subsidiary or affiliated companies described in the previous section, without the prior consent of the data subjects.
5. Changes to the Privacy Notice
"atoms studio" reserves the right to change the content of this Privacy Notice at any time. In the event of any change to this Privacy Notice, you will be notified through our website at www.atomstudio.com.mx.
